SC Seeks UP Govt’s Response on Siddique Kappan’s Bail Condition

New Delhi, 17th Sept. The Supreme Court has asked the Uttar Pradesh government to respond to a plea by Kerala-based journalist Siddique Kappan, who is seeking relaxation of a bail condition requiring him to report to police every week. The plea was considered by a bench of Justices P.S. Narasimhan and R. Mahadevan on Tuesday.

Kappan, who was arrested in October 2020 while en route to Hathras, Uttar Pradesh, following the death of a Dalit woman who had been gang-raped, had been granted bail on September 9, 2022. The Supreme Court’s bail order stipulated that Kappan remain in Delhi for six weeks after his release and report to the Nizamuddin police station every Monday. Additionally, he was to stay within the jurisdiction of Nizamuddin and could only travel to his native Malappuram in Kerala after six months, subject to similar reporting requirements at the local police station.

The FIR against Kappan and three others included charges under the Indian Penal Code and the Unlawful Activities (Prevention) Act (UAPA), with allegations of links to the Popular Front of India (PFI). The PFI had previously been accused of funding protests against the Citizenship Amendment Act (CAA). Police claimed the accused were attempting to disrupt law and order in Hathras.

The case has drawn significant attention due to the high-profile nature of the Hathras incident, where the victim died at a Delhi hospital two weeks after the alleged assault. Her family alleged that her cremation was conducted without their consent and that they were not permitted to bring her body home for a final farewell.

The Supreme Court has scheduled the next hearing of Kappan’s plea in two weeks, while the Uttar Pradesh government is expected to file its response.
