New Delhi, 25th Sept. The Supreme Court on Wednesday closed the case against Karnataka High Court Judge, Justice Vedavyasachar Srishananda, following his public apology for controversial remarks made during a court session. The comments, which went viral on social media, referred to a Muslim-majority area in Bengaluru as “Pakistan” and included a misogynistic remark directed at a woman lawyer.
Chief Justice of India (CJI) DY Chandrachud, leading a five-judge bench, stated that the decision was taken in the interest of justice and to uphold the dignity of the judiciary. “No one can call any part of the territory of India as Pakistan,” said CJI Chandrachud, emphasizing that such remarks undermine the country’s territorial integrity.
Background of the Case
Justice Srishananda made the comments while hearing a landlord-tenant dispute. The first involved referring to a Muslim-majority locality as “Pakistan,” and the second was an inappropriate comment directed at a woman lawyer, insinuating she had intimate knowledge of the opposition party.
The remarks triggered widespread backlash on social media, prompting the Supreme Court to take up the matter on its own and request a report from the Karnataka High Court. The report was submitted soon after the incident.
Supreme Court’s Ruling
Addressing the incident, the bench, which included Justices S Khanna, B R Gavai, S Kant, and H Roy, stressed the need for judges to be cautious about their remarks. CJI Chandrachud noted, “Casual observations may indicate personal biases, especially when perceived to be directed at a certain gender or community. Patriarchal or misogynistic comments are unacceptable.”
The bench further highlighted the role social media plays in amplifying courtroom proceedings, adding urgency to ensuring judicial commentary remains within the bounds of decorum expected in a court of law. Videos of Justice Srishananda’s comments were widely circulated, raising public concern.
Apology and Conclusion
In light of Justice Srishananda’s public apology, the Supreme Court opted to close the case but emphasized that such incidents should not be repeated. The court expressed hope that all judges would exercise caution and impartiality when discharging their duties.
