New Delhi, 6th Oct. The Delhi High Court is set to hear the bail plea of former JNU student Umar Khalid on Monday in connection with a UAPA case related to the alleged conspiracy behind the February 2020 Delhi riots. Khalid, arrested in September 2020, has been accused of being a “mastermind” in the violence that left 53 dead and over 700 injured, primarily during protests against the CAA and NRC. The case against him includes charges under the Unlawful Activities (Prevention) Act (UAPA) and the Indian Penal Code (IPC).
The bail pleas of other co-accused, including student activist Sharjeel Imam, Gulfisha Fatima, and ‘United Against Hate’ founder Khalid Saifi, are also scheduled for hearing before a bench of Justices Navin Chawla and Shalinder Kaur. These cases were earlier handled by a bench led by Justice Suresh Kumar Kait, who was recently transferred to the Madhya Pradesh High Court as its Chief Justice.
The violence in February 2020 erupted during protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC). Khalid, along with other co-accused, has been charged with orchestrating the riots during alleged conspiratorial meetings. His earlier bail pleas were denied by the trial court, with the most recent rejection occurring on May 28, 2023.
Khalid had appealed this decision, but the Delhi High Court upheld the trial court’s dismissal of his first bail plea on October 18, 2022. The court stated that the allegations against him were prima facie true and that the anti-CAA protests had evolved into violent riots, allegedly orchestrated through conspiratorial meetings, in which Khalid was purportedly involved.
