New Delhi, 17th Oct. In a significant legal victory, the New Delhi District Court has granted a permanent injunction against a Bhopal-based organization using a deceptively similar name, “Jan Aushadhi Sangh,” in violation of the registered trademark “Jan Aushadhi.” This trademark is owned by the Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP) under the Department of Pharmaceuticals, Government of India.
The court found that the Bhopal firm was intentionally trying to create confusion among the public to exploit the goodwill associated with the Jan Aushadhi brand. As a result, the court has ordered the violators and their associates to cease using the name “Jan Aushadhi” in any form.
In addition to the injunction, the court mandated that all materials bearing the infringing trademark be handed over to PMBI for destruction. The court also awarded damages amounting to ₹10 lakhs to PMBI, reinforcing the protection of its brand integrity and ensuring consumers can access authentic products at affordable prices through Jan Aushadhi Kendras.
Launched by the Department of Pharmaceuticals, the Pradhan Mantri Bhartiya Janaushadhi Pariyojana aims to provide quality generic medicines at lower prices. It operates a network of 13,800 Jan Aushadhi Kendras across the country, allowing consumers to save between 50% and 90% on medication costs. Over the years, Jan Aushadhi has emerged as India’s largest retail pharmacy chain.
