New Delhi, 14th Sept. The Centre informed the Supreme Court that “sensitive material” in its possession is causing delays in implementing the Supreme Court Collegium’s recommendations for appointing chief justices to high courts.
Attorney General R. Venkataramani presented this information to a bench comprising Chief Justice D.Y. Chandrachud and Justices J.B. Pardiwala and Manoj Misra.
Venkataramani indicated that disclosing these sensitive issues publicly could be detrimental to both the institution and the judges involved. He proposed submitting the inputs and his suggestions in a sealed cover for the court’s review.
The Supreme Court has scheduled a hearing for September 20 to further address the matter. This follows a plea by advocate Harsh Vibhore Singhal, who has requested the court to mandate a time frame for the Centre to notify the appointments recommended by the collegium.
Singhal’s plea also seeks to eliminate the “zone of twilight”—a period during which the government may delay the appointment notifications.
Singhal’s petition argues that the lack of a fixed timeline allows the government to arbitrarily delay these appointments, thereby compromising judicial independence and undermining the constitutional and democratic order.
The plea suggests that if no objections are raised and appointments are not notified by the end of a stipulated period, such appointments should be deemed as officially made.
